Welcome to Desert Estate Home Watch. These Terms & Conditions ("Terms") govern your use of the Desert Estate Home Watch website and your interactions with Desert Estate Home Watch through this website.
By accessing or using this website, submitting a request for services, or otherwise interacting with Desert Estate Home Watch through the website, you agree to these Terms.

1. About Desert Estate Home Watch
Desert Estate Home Watch provides home watch, property observation, arrival and departure assistance, access coordination, key-holding, concierge, and related services for homeowners and properties within our service area.
Home watch services consist primarily of scheduled visual observations of a property intended to identify readily observable conditions or irregularities while the homeowner is away.
Desert Estate Home Watch is not a security company, alarm company, property management company, home inspection company, construction contractor, insurance company, emergency response service, or law enforcement agency.
Our services are not a substitute for security systems, alarm monitoring, insurance coverage, licensed property inspections, property management, or services that must legally be performed by a licensed professional.

2. Website Information
We make reasonable efforts to ensure information presented on this website is accurate and current. However, service descriptions, availability, pricing, service areas, features, and other information may be changed or updated at any time.
Information on this website is provided for general informational purposes and does not constitute a guarantee that a particular service will be available for a specific property.
A request submitted through the website does not create a service relationship until Desert Estate Home Watch has accepted the client and any required service agreement has been completed.

3. Service Agreements
Clients receiving ongoing home watch or other contracted services may be required to enter into a separate written Home Watch Service Agreement.
That agreement may contain additional provisions concerning:

Services to be performed
Visit frequency
Property access
Client responsibilities
Fees and payment authorization
Cancellation
Emergency procedures
Key handling
Contractor or vendor access
Liability
Insurance
Additional or concierge services

If there is a conflict between these website Terms and a signed Home Watch Service Agreement, the signed Home Watch Service Agreement will control with respect to the contracted services.

4. Nature and Limitations of Home Watch Services
Home watch visits are observational in nature.
Unless specifically stated otherwise in a written service agreement, our personnel do not perform invasive inspections, dismantle equipment, enter inaccessible or unsafe areas, climb onto roofs, move heavy objects, conduct engineering evaluations, diagnose mechanical systems, or perform services requiring a professional or occupational license.
Home watch services cannot guarantee the prevention or discovery of every condition that may affect a property.
Conditions may arise between scheduled visits or may not be reasonably observable during a visit, including but not limited to:

Water leaks or plumbing failures
HVAC or appliance failures
Electrical problems
Roof or structural damage
Pest or wildlife activity
Mold or moisture conditions
Pool or landscape problems
Security breaches
Theft, vandalism, or trespassing
Weather-related damage
Utility interruptions
Internet, alarm, or automation system failures

Desert Estate Home Watch does not guarantee that every defect, malfunction, loss, intrusion, or hazardous condition will be detected or prevented.

5. No Security or Emergency Monitoring
Desert Estate Home Watch does not provide continuous surveillance, security patrol services, alarm monitoring, emergency dispatch, or law enforcement services.
Homeowners remain responsible for maintaining appropriate security systems, alarm monitoring, insurance, emergency contacts, and other protective measures for their property.
If an apparent emergency is discovered during a scheduled visit, Desert Estate Home Watch may contact the homeowner, designated emergency contact, emergency services, utility provider, service professional, or other appropriate party depending on the circumstances and the authorization provided by the client.
We cannot guarantee response times or the availability of third parties.

6. Property Access
Clients are responsible for providing safe and lawful access to the property and any areas included within the agreed scope of service.
This may include functioning:

Keys
Gate access devices
Entry codes
Alarm codes
Garage remotes
Smart-lock access
Community or HOA authorization

Desert Estate Home Watch is not responsible for a missed, delayed, or incomplete visit when access is prevented by circumstances outside our reasonable control.
Clients are responsible for promptly notifying us of changes to locks, alarm systems, gate procedures, access codes, authorized occupants, contractors, guests, tenants, or other conditions affecting access to the property.

7. Keys and Access Devices
When Desert Estate Home Watch agrees to retain a key, remote, access device, or access credential, reasonable measures will be used to safeguard it.
Clients authorize Desert Estate Home Watch to use supplied access methods as reasonably necessary to perform authorized services.
Keys and access credentials will not be intentionally released to third parties except with client authorization, in an emergency, when required by law, or as otherwise provided in the applicable service agreement.

8. Contractors, Vendors, and Third Parties
At a client's request, Desert Estate Home Watch may provide access to or coordinate with contractors, repair professionals, delivery personnel, housekeepers, pool professionals, landscapers, pest-control providers, or other third parties.
Unless expressly agreed otherwise in writing, Desert Estate Home Watch does not employ, supervise, warrant, guarantee, or assume responsibility for independent third-party service providers.
The homeowner remains responsible for selecting, hiring, approving, and paying third-party providers.
Coordination or access assistance does not constitute construction management, property management, or a guarantee of the quality or completion of another party's work.

9. Concierge and Add-On Services
Additional services may be available by request, including arrival preparation, departure assistance, mail or package handling, grocery or household stocking, vehicle-related observations, contractor access, delivery coordination, and other concierge services.
Additional services may:

Require advance scheduling
Carry separate fees
Be subject to availability
Require additional authorization
Have separate terms or limitations

Submitting a request does not guarantee availability or acceptance of the requested service.

10. Photographs, Reports, and Property Documentation
As part of home watch services, Desert Estate Home Watch may create photographs, videos, written observations, time records, checklists, or electronic reports documenting property conditions and services performed.
These materials may be maintained as business records and provided to the client.
Property photographs and reports are intended for service documentation and informational purposes. They are not professional property inspections, engineering reports, insurance inspections, appraisals, or certifications regarding the condition of the property.
Desert Estate Home Watch will not knowingly use identifiable interior property photographs for public advertising or promotional purposes without appropriate authorization.

11. Client Responsibilities
Clients are responsible for providing accurate and current information concerning their property, including relevant information about:

Alarm systems
Water shutoffs
Electrical panels
HVAC systems
Utility providers
Emergency contacts
Authorized vendors
Pets or animals
Pools and spas
Irrigation systems
Known defects or hazards
Access restrictions
HOA or community requirements

Clients are responsible for maintaining appropriate homeowners insurance or other property insurance.
Clients should notify their insurer when a residence will be unoccupied or vacant for an extended period and determine whether their insurance policy imposes vacancy, inspection, occupancy, or other requirements.
Desert Estate Home Watch does not interpret insurance policies and does not guarantee that its visits satisfy the requirements of any insurance carrier.

12. Unsafe Conditions
Desert Estate Home Watch may decline to enter or remain in any area that reasonably appears unsafe.
Unsafe conditions may include fire, flooding, electrical hazards, suspected gas leaks, aggressive animals, criminal activity, structural instability, hazardous substances, extreme environmental conditions, or any other situation presenting an unreasonable risk.
A visit may be limited, delayed, or discontinued under such circumstances.

13. Scheduling and Service Interruptions
Scheduled services may occasionally be delayed, modified, or prevented by circumstances outside our reasonable control, including severe weather, road closures, natural disasters, governmental orders, utility disruptions, community access restrictions, emergencies, illness, unsafe property conditions, or similar events.
When reasonably practicable, Desert Estate Home Watch will attempt to communicate material service interruptions to affected clients.

14. Fees and Payment
Fees for services are established through the applicable service plan, proposal, invoice, authorization, or Home Watch Service Agreement.

Ongoing Home Watch service plans are billed on a recurring basis. By enrolling in an ongoing service plan and providing a payment method, the client authorizes Desert Estate Home Watch and its payment processor to automatically charge the payment method on file for recurring service fees in accordance with the billing frequency disclosed at enrollment or in the Home Watch Service Agreement.

Recurring charges will continue until service is canceled in accordance with Section 15 below.

Clients are responsible for maintaining a valid and current payment method for the duration of recurring service. If a recurring payment is declined or cannot be processed, Desert Estate Home Watch may contact the client for an updated payment method and may suspend future services until the account is brought current. Additional or concierge services outside the client's regular service plan may be billed separately or charged to the payment method on file when authorized. Applicable taxes, processing charges, third-party expenses, emergency purchases, or other authorized costs may also be charged as permitted by the applicable agreement.

15. Recurring Services and Cancellation
Ongoing Home Watch service plans continue on a recurring basis until canceled.

Clients must provide at least thirty (30) days' written notice to cancel an ongoing Home Watch service plan.

Cancellation notice may be submitted using the cancellation method identified in the client's Home Watch Service Agreement or by contacting Desert Estate Home Watch through an approved written communication method.

The cancellation will become effective after the applicable 30-day notice period. The client remains responsible for recurring service fees and any authorized services performed during the notice period.

Providing cancellation notice does not automatically cancel amounts already due, charges for services previously performed, authorized third-party expenses, or other outstanding balances.

If the client's next recurring billing date occurs during the 30-day notice period, a recurring charge may still be processed for service falling within that notice period, subject to the terms of the client's Service Agreement and applicable law.

Desert Estate Home Watch will not require a client to continue recurring service beyond the applicable cancellation notice period unless otherwise agreed in writing.

Nothing in these Terms is intended to restrict any cancellation, renewal, or consumer rights that cannot legally be waived under applicable law.

16. Purchases and Emergency Expenses
If a client authorizes Desert Estate Home Watch to make purchases or incur third-party expenses on the client's behalf, the client agrees to reimburse those expenses together with any applicable service or coordination fee disclosed in advance or contained in the service agreement.

Except when specific emergency authority has been provided, Desert Estate Home Watch is not obligated to make purchases, authorize repairs, or incur expenses on behalf of a client without approval.

17. Communications
By providing a telephone number, email address, or other contact information, you authorize Desert Estate Home Watch to communicate with you concerning inquiries, appointments, property observations, service reports, billing, account administration, emergencies, and related service matters.

Electronic communications may include email, telephone calls, text messages, electronic reports, or communications through service-management software.

Marketing communications, where used, will be handled in accordance with applicable law and any available opt-out requirements.

18. Website Submissions
You agree that information submitted through this website will be accurate and that you will not knowingly:

Submit false or misleading information
Impersonate another person
Attempt to gain unauthorized access to the website or related systems
Introduce malicious software or harmful code
Interfere with operation of the website
Use the website for unlawful purposes

We may restrict website access when reasonably necessary to protect our systems, clients, or business.

19. Intellectual Property
Unless otherwise stated, website content including text, service descriptions, graphics, photographs, logos, branding, design elements, and other original materials is owned by or licensed to Desert Estate Home Watch and is protected by applicable intellectual-property laws.
Website materials may not be copied, reproduced, distributed, modified, republished, or used commercially without prior permission except as permitted by law.

20. Third-Party Websites and Services
This website may contain links to third-party websites, payment processors, scheduling platforms, mapping services, social-media platforms, or other outside services.
Desert Estate Home Watch does not control those third parties and is not responsible for their content, availability, privacy practices, security, products, or services.
Use of third-party services may be subject to their own terms and policies.

21. Disclaimer of Warranties
To the extent permitted by applicable law, this website and its content are provided on an "as available" basis.
Desert Estate Home Watch does not warrant that the website will always be uninterrupted, error-free, secure, or free from harmful components.
Home watch and related services are subject to the terms and limitations contained in the applicable service agreement.
Nothing in these Terms excludes warranties, protections, or rights that cannot lawfully be excluded.

22. Limitation of Liability
To the maximum extent permitted by applicable law, Desert Estate Home Watch will not be responsible for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of, or inability to use, this website.
Liability relating to contracted home watch, concierge, or other services is governed by the applicable Home Watch Service Agreement and California law.
Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited.

23. Privacy
Information collected through this website is handled in accordance with our Privacy Policy.
The Privacy Policy should be reviewed together with these Terms.

24. Changes to These Terms
Desert Estate Home Watch may update these Terms periodically to reflect changes in our services, website, business practices, or legal requirements.
The current version will be posted on this page with an updated effective date.
Changes will apply prospectively unless otherwise required by law.

25. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute concerning these website Terms will be subject to the jurisdiction of the appropriate courts located in Riverside County, California, except where applicable law requires otherwise.

26. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
